1. Acceptance of Terms

By accessing or using the website located at whiterocklocators.com (the “Site”) and any services provided by Whiterock Locators (“Company,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Site or our services.

2. Description of Services

Whiterock Locators is a licensed apartment locating service operating in the Dallas-Fort Worth metropolitan area. We help renters find apartments at no cost to the renter. Our services include:

• Searching apartment communities that match your stated preferences
• Providing apartment recommendations based on your budget, location, and lifestyle needs
• Offering a cash back rebate program where eligible clients receive a portion of the commission we earn from apartment communities

We are licensed by the Texas Real Estate Commission (TREC) and operate in compliance with all applicable Texas real estate laws and regulations.

3. Eligibility

You must be at least 18 years of age to use our services. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts and Information

When you complete our apartment search quiz or otherwise provide information through the Site, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

We reserve the right to refuse service, terminate accounts, or cancel requests at our sole discretion if we believe any information you provide is inaccurate, incomplete, or fraudulent.

5. Cash Back Rebate Program

Whiterock Locators offers a cash back rebate program under the following terms:

• Commission Structure: Apartment communities pay Whiterock Locators a commission when a client signs a lease. This commission varies by community and typically ranges from 50% to 150% of one month's rent.
• Rebate Amount: Eligible clients receive 50% of the commission Whiterock Locators earns from the apartment community. The exact rebate amount depends on the commission rate and rent amount.
• Attribution Requirement: To be eligible for the cash back rebate, you must identify “Whiterock Locators” as your referring locator on your apartment application and in all communications (written, phone, and in-person) with the apartment community. Failure to properly attribute Whiterock Locators may result in loss of commission and therefore loss of your rebate.
• Payment Timeline: Rebate payments are made after Whiterock Locators receives commission payment from the apartment community, which typically occurs 30 to 60 days after your move-in date.
• Payment Method: Rebates are paid by check mailed to the address you provide or via electronic transfer at our discretion.
• No Guarantee: Rebate amounts shown on the Site are examples only and do not guarantee a specific rebate amount. Actual rebate amounts depend on the commission paid by the specific apartment community where you sign a lease.
• Eligibility: The cash back rebate is available only to clients who are introduced to an apartment community through Whiterock Locators. Clients who have already contacted or applied to a community prior to engaging our services may not be eligible.

6. No Guarantee of Results

While we strive to find apartments that match your stated preferences, we do not guarantee that we will find a suitable apartment for every client. Apartment availability, pricing, and terms are controlled by apartment communities and are subject to change without notice. We do not guarantee lease approval, and all lease agreements are between you and the apartment community.

7. Free Service

Our apartment locating service is provided at no cost to you. We are compensated by apartment communities through commission payments. You will never be charged a fee by Whiterock Locators for our locating services.

8. Consent to Communications

By providing your contact information through the Site, including your phone number and email address, you expressly consent to receive communications from Whiterock Locators related to your apartment search and our services. This consent includes:

• Phone Calls: You consent to receive phone calls from Whiterock Locators and its agents at the phone number(s) you provide, including calls made using an automatic telephone dialing system or prerecorded/artificial voice messages, for purposes related to your apartment search, service updates, appointment scheduling, and follow-up communications.
• Text Messages (SMS/MMS): You consent to receive text messages from Whiterock Locators at the phone number(s) you provide, including messages sent using an automatic telephone dialing system, for purposes related to your apartment search, appointment reminders, property recommendations, and service updates. Message and data rates may apply. Message frequency varies based on your apartment search activity.
• Email: You consent to receive emails from Whiterock Locators at the email address(es) you provide, including apartment recommendations, service updates, rebate information, and marketing communications related to our services.

Opting Out: You may opt out of communications at any time:

• Text Messages: Reply STOP to any text message to unsubscribe from future text messages. Reply HELP for assistance.
• Email: Click the “unsubscribe” link at the bottom of any marketing email, or email us at contact@whiterocklocators.com with the subject line “Unsubscribe.”
• Phone Calls: Inform us during any call that you wish to be placed on our do-not-call list, or contact us at contact@whiterocklocators.com.

Opting out of communications may limit our ability to provide our apartment locating services effectively. Please note that even after opting out of marketing communications, you may still receive transactional messages related to an active apartment search or pending rebate payment.

Your consent to receive communications is not a condition of purchasing any goods or services. However, providing your contact information and consenting to communications is necessary for us to deliver our apartment locating services.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Whiterock Locators or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

10. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to any portion of the Site or its systems
• Use automated tools, bots, or scrapers to access or collect data from the Site
• Interfere with or disrupt the Site or its servers and networks
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Site to transmit spam, chain letters, or other unsolicited communications

The Site may contain links to third-party websites or services that are not owned or controlled by Whiterock Locators. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You access third-party websites at your own risk.

12. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITEROCK LOCATORS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT OF ANY REBATE PAYMENT OWED TO YOU, IF ANY.

14. Indemnification

You agree to indemnify, defend, and hold harmless Whiterock Locators and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of such courts.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Termination

We may terminate or suspend your access to the Site and services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Whiterock Locators regarding your use of the Site and services, and supersede all prior agreements and understandings, whether written or oral.
